Non-Aggression Principle and Vice - Where's the Crime?
One of the tenets of individual liberty is the Non-Aggression Principle (NAP), which states that no person has the right to initiate force or fraud against any other person for any reason. When the NAP comes up against criminal law as it relates to vices, both should be tested honestly.
Societies have had an ongoing debate about Crime and Vice over centuries. Much of this perpetual conflict comes from the organized Church, which has formulated moral positions on various human behaviors. If you read Old Testament law, you'll find a lot of human acts listed with penalties for committing those acts. But you'll also find that Scriptural penalties are restorative, meaning that they require the perpetrator to make restitution, not incarceration for punishment.
So, in the times in which we live, how does this affect us? Should vices be crimes?
The dictionary defines "vice" as "an immoral or evil habit or practice." It defines "crime" as "an action or an instance of negligence that is deemed injurious to the public welfare or to the interests of the state and that is legally prohibited."
The first challenge is in the definition of "vice." Who makes the determination that any human action is immoral or evil? One man's vice could be another man's living. Each person must have the liberty to test every alleged vice to determine of his own judgment and conscience what may be good and what may be evil.
Some folks have a knee-jerk reaction to vices, and believe that they should be prosecuted by law enforcement and the courts. But is this belief founded in law, old traditions, habits or any desire for liberty?
Punishing crime is meant to guarantee to every person the fullest liberty he can realize that is also consistent with the full liberty of others. An individual must be free in the "pursuit of happiness," even to practice vices that others detest. An individual must be free to use his own judgment, his own body and his own property without restriction so far as the use does not interfere with another individual's quiet enjoyment of his own person and property.
Everyone wants to be protected against violations from other men. But no one wants to be "protected" from himself, since someone else is determining what "protection" is.
So the punishment of crimes can be justified, but the punishment of vices deprives every individual his natural right to pursue his own happiness, the full use of his body and his own property. These two actions are polar opposites, directly opposed to one another. Criminalizing vice is absurd and a crime of itself. Governments should not be instituted and maintained that commit crimes and prosecute crimes simultaneously.
As the philosopher Sallust said in ancient Rome, "Most men do not desire liberty. Most only wish for a just master." But masters make the rules that their property live by. Living under such rules and regulations does not cause people to be more virtuous or more free. It makes them small-minded and vicious and eager to make their fellow man suffer. The minds of men are not elevated by such stupidity, but whipped into shape by superstition and the exercise of raw power.
Here is a list of various vices. You may argue that each is a sin, but you cannot argue successfully that any one of these vices should be a crime. That is, unless you are capable of Cognitive Dissonance, which is holding two opposing viewpoints in your mind at once.
Gambling: This is to risk money, or anything of value, on the outcome of something involving chance. There is no force in a wager. If fraud is determined, then prosecution for that fraud is indicated. But gambling has no victim, and therefore should not be criminal acts. Do not be misled into thinking that those who gamble excessively are victims. They should have the liberty to use their resources in any manner they choose, including wasting the resources. Anything less that this level of individual liberty is tyranny. It is the State attempting to protect individuals from themselves. It is massively hypocritical that many States run gambling operations, but criminalize individuals who do the same.
Prostitution: a voluntary exchange of sexual activity for valuable consideration between two or more individuals. There is no force. If the parties begin their exchange, and either one says "No," further sex would be considered force. If one party infected any other party with a disease, that would be a tortious injury. If one party accepted valuable consideration and did not perform the desired sex act, it would be fraud. So absent intent, force or fraud, prostitution should be entirely legal.
Sex acts including Homosexuality: Sex acts between two or more consenting adults have no victims. There is no intent to harm, commit force or fraud. If some physical harm were to befall any party, they could seek damages in the courts. So, there is not crime in consentual sex acts. Homosexual individuals are free under law to enter into contracts regarding cohabitation and all it entails. If a homosexual can locate a religious leader that will perform a "marriage" ceremony, nothing should prevent that. But the "marriage" should not gain a legal status, since the State has no standing or vested interest in any marriage other than to tax and license it.
Marriage: The Bible is full of men with multiple wives, and most are the pillars of the Christian and Jewish faiths. There should exist no law that prohibits polygamy. The laws against assault, battery, force or fraud are in existence to deal with any criminal issues. The civil courts are available to deal with divorce, child custody and support, and the division of assets. But the State has no standing or vested interest in any marriage other than to tax and license it.
Pornography is sexually explicit pictures, writing, or other material whose primary purpose is to cause sexual arousal. If there is a free exchange of valuable consideration for the pornographic material, then no force or fraud has been committed. If the pornographer uses children, defined as individuals below the age of legal adulthood, who cannot contract for themselves, then there are victims of injury, force or fraud. Those torts should be prosecuted and restoration should be required.
Recreational drug and alcohol use: The use of any substance by a human being to alter his own consciousness is an act without a victim. The user is entirely within his individual liberty to use as little or as much of the substance as he chooses, even to the point of his own death. Mere possession of a substance shows no intent. Private use shows no fraud or force. Recreational drug use should be legal.
Recreational drug /alcohol manufacture and sales: If a manufacturer or grower of any product should manufacture a defective product, there would be fraud and product liability torts could be subject to legal remedy. There is no force in a free exchange of valuable consideration for the manufactured product. So the manufacture and sale of recreational drugs and alcohol should be legal.
Drunk Driving: The mere ingestion of alcoholic beverages should not ever constitute a crime. A person driving a vehicle under the influence of alcohol who causes no harm or damage to another individual or his property commits no crime. There must be a victim for there to be a crime. This person under the influence has not committed force or fraud either. So drunk driving laws are not compatible with personal liberty and should be rescinded.
Counterfeiting is an imitation intended to be passed off fraudulently or deceptively as genuine. The US Federal Government, through the Federal Reserve, prints paper currency that has no redemption value. Genuine currency issued by a 100% gold/silver reserve bank would have 100% redeemability. Fractional reserve banking is also counterfeiting since it creates credit with no underlying value. So counterfeiting is fraud, and should be illegal...even when a nation does it.
Cheating in any form is fraud, which has penalties under criminal law.
Lying in any form is fraud. Perjury is lying under oath in a legal proceeding. So, lying may be subject to criminal penalties and restitution of some form. The trick is how to determine how much lying is criminal and how little is legal.
Stealing is depriving another individual of his property...or even his life... by force or fraud. Restitution should be made, but should incarceration be part of the penalty? What purpose does incarceration serve other than punishment? The prisons are full of prisoners who stole things. Were the victims made whole again?
Gun laws: Many gun laws across America make the very possession of a firearm a criminal act. Some outlaw possession in certain locations, Some outlaw concealed carry of a firearm. But the only determinants of criminality should be intent, force or fraud against another individual. Therefore, the criminality of gun possession is itself criminal.
Conclusion
This author holds the hope that the Framers of a new nation, born of a secession by a sovereign US State, will throw off the shackles of old superstitions and traditions and embrace individual liberty once again.

In 1979, in what promised to be an easy military operation, the Soviet army invaded Afghanistan.
Six years later, with his forces bogged down in a costly and open-ended guerilla war, Mikhail Gorbachev gave his generals a year to win, with whatever means they needed to succeed. They failed, and the Soviet government spent the following three years extricating its forces. The Afghan failure was a major factor in the collapse of the USSR.
The Soviets had been in Afghanistan for seven years when they gave up and decided to withdraw. By now the US has been there almost a year more.
There is no intention here to establish a moral equivalence between the US and Soviet campaigns. The Red Army was brutal and ruthless, killing up to 15 percent of the Afghan population, and driving half of the remainder out of the country.
By contrast, the US went into Afghanistan to get the man who had gratuitously murdered nearly three thousands American citizens. The Afghans fought on our side against the hated Taliban. We were welcome.
Yet, from the military point of view, we have done no better than the Soviets. After nearly eight years we face a growing insurgency that is established in nearly half of the country, and reaching into the other half. We need to understand why.
Clausewitz defined war as the pursuit of policy by other means.
The means here are our military forces. They are professional, well trained, extremely well armed, and they have fought honorably and well. They cannot be blamed.
If the fault is not with the means, then the policy must be wrong. We started out with all the advantages on our side and won a quick victory. It was downhill from there. Why?
Let us go back to the Afghans for a while. They are not a nation, but a confederation of ethnic and tribal groups. They are poor. They practice various forms of Islam, which in the West are mostly considered retrograde.
Nevertheless they are a proud people and they can fight. In the 19th century they took on the British Empire and kept it out of Afghanistan. They fought the Soviets and chased then out. They fought with us against the Taliban and won. Then we somehow lost them, and now the Taliban is back.
The reason is very simple: by our own choice, we changed from liberators to occupiers. Instead of giving Afghanistan back to its people we decided to keep and remold it to our own liking.
In a country that begs for a federal system, we set up an artificial central government with no popular support or power base. We disbanded the militias that fought for us and removed their leaders from power, and then proceeded to create our own Afghan army from scratch. We ran the place and still run it as if it belonged to us.
In other words, we left very little to the Afghans that they could call their own. We gave them freedom and democracy, but on our terms, not theirs. They don't own it, and people will not fight to keep what they do not own.
We do, however, have one opportunity, which may well be our last chance.
The local government we so laboriously created and propped up has disqualified itself by rigging an election. This gives us a brief window to change tack, rework our policies and possibly start again.
There are still places in Afghanistan that the Taliban has not penetrated, like Bamyan province. This is where we should focus first and foremost; provide whatever economic aid is needed; arm, train and support the locals, so they can defend what they have; promote local leaders and let them run their show. All in all, we must show that we will promote Afghan interests as they see them, rather than according to our own concepts.
Whenever this approach has been tried, as in Khost province for a while, it worked. If we applied it across the board, we could start pulling out our troops within a year or two.
It will require us to admit our mistakes and give up some cherished, if questionable, myths. But that is a small price to pay for a real victory.

Why There's No Excuse For Poverty and How You Can Claim Your Greatest Asset
Recently I heard someone complaining about how she lost her house because her 7-year Adjustable Rate Mortgage expired and the payment went up. The way this woman was talking, I figured the payment increased at least a thousand dollars. Curious, I asked, "Wow, how much did it go up?" and she replied, "One hundred dollars."
She and her husband lost the house for one hundred dollars a month. Now there's just one word that comes to mind for this: Stupidity! For just one hundred dollars, they lost their home and had to move from place to place with their young kids (who, of course, were completely traumatized by the lack of stability, school changes, and constant upheaval.)
Why didn't this couple, who were in good health and had each other to bring in two incomes, get resourceful and just do SOMETHING to create that small amount of money? (By the way, I need to tell you that they both had decent jobs; neither one of them was unemployed.)
Surely he could have mowed two lawns a month to keep their home. (And believe me, anyone who can walk can mow! There was a well-loved fellow here in Chapel hill who for many years owned and operated a thriving landscaping business--and he had no arms! He created success from what he had rather than lamenting what he didn't have!)
There is no excuse for being poor. Even if you're in a body cast or paralyzed, you can be successful, as the mouth and foot painting artists have proven. (Any doubt about this? Keep this in a prominent place in your home or office so when you feel like sitting on your pity pot, you'll get off your arse, as Shakespeare would say, and DO something proactive.)
Look at yourself! I bet that you're in good health, have all your limbs, and enjoy ample food, adequate shelter, and loving people and pets who adore you. And even more so, you have a life experience like no other.
Hey, it's time to get off your ass-et! (Couldn't resist that...) Take an honest look at yourself. Are you being lazy about something that could save or make you money? What do you need to rearrange in your life so you can really be prosperous?
Maybe you hang out with people who are always complaining about not having enough money (Ahem, maybe you're one of those people). Maybe you won't remind your friend about the money she borrowed and promised to pay back two years ago. Maybe you are guzzling or smoking your money in the form of alcohol or cigarettes.
What do you need to change? Call a friend who loves you enough to give you a gentle butt kick and tell them now! And ask them to hold you accountable. Tell them to pester you, and keep on nagging you until you change your poverty-riddled habits into prosperity-attracting ones. It's your life. Aren't you tired of making excuses?

The Dangerous World of Regency England
Although on occasion the Bow Street Runners, the then law enforcers of London, traveled into the country where one of their criminal cases might lead them, the country areas were policed by magistrates. These in turn appointed constables, who jailed and bound criminals over to said magistrates. Justices of the Peace dealt with minor offences at the Petty Sessions. More severe cases were held four times a year at the Quarter Sessions. The most severe cases were referred by the Quarter Sessions to the sitting judges to hear at the Assizes.
The Magistrates were appointed by the Crown and drawn from the landowning aristocracy, the country gentry, and the Anglican clergy, who were often related to noble houses.
According to Roger Swift, who wrote about the Magistracy in Nineteenth century England, (see below for full title of Abstract), the country magistrates wielded considerable power. Many towns were as yet incorporated, so these and the country were the province of the magistrate. "The magistracy exercised a wide range of administrative responsibilities which included the licensing of alehouses, the inspection of prisons and lunatic asylums, the superintendence of roads, public buildings and charitable institutions, and the application of laws against vagrancy...(and they) adjudicated in the settlement of disputes...." (p.75)
These men presumably saw to justice, but the poor suffered greatly and biased magistrates had children transported to Australia for stealing bread for their sick mothers. Poaching, carried on to feed starving families whose land had been enclosed by their wealthy neighbors, was severely punished. Transportation and hanging were common. Although many landowners of the nobility employed the poor on their estates, much of the injustices continued until reforms came in during the Victorian period.
Returning soldiers from the Peninsular wars, who lacked family, and could afford fares to the country, unable to find employment, were caught up in poaching. Sabbath breaking was frowned upon, so that drinkers and gamblers caught thus were placed in stocks on the public 'green' for one and all to see. Abuses occurred in the northern areas of England, for example mining, where workers were paid by food or goods rather than money well into the Victorian period.
Compared to London, the dangers in the country were less. Despite this, some biased magistrates still treated vagrancy with transportation. Usually this punishment was for seven years, but in the case of children, mothers' hearts were torn apart--for if their children survived the journey by ship, they were never seen again. It was said that the work amongst the gangs of Botany Bay was hard. Only the strong survived, and few made it back to England.
The Regency world of England for the poor, disadvantaged, and trespassers, was truly a dangerous place. My heros and heroines had much to contend with in their fight against oppression.

Do You Read Business Week? I Do and Now I'll Read it Even More
As you know BusinessWeek is one of the staple business magazines in the United States. It is packed full of information each week with little business tidbits, investor intelligence, and also in-depth stories that are very much worth reading. In fact, I read business week each and every week, along with several of the other online and printed daily business newspapers. Obviously, that is a lot of are reading, and like most people I don't read every article, just the ones that hit my fancy.
Over the years, I have been a little concerned with some of the BusinessWeek content because I find it, often has an unfortunate anti-capitalists stand in at least a few of the articles. This often bothers me, however I have recently learned that Bloomberg media may be buying BusinessWeek magazine. It makes sense that Bloomberg would buy this business weekly magazine right now, because we are emerging from the recession.
It's hard to say how much BusinessWeek might bring on the open market, but it should also be noted that the company is in debt, and if it is not sold it will probably go out of business like many other recent magazines that have closed their doors in 2009. Many are concerned in the print media magazine business, because so many magazines have gone out of business in the last year.
Mostly due to declining advertising revenue, which is off more than 50%, and yet, it would be a shame to see such a business magazine, one which has been such a mainstay for so many decades. Apparently, there are over 400 people that work for BusinessWeek, and if Bloomberg buys them they will most likely be laid-off or parachuted away. The landscape in business print media magazines is changing fast. I hope you will please consider all this.
